Terms and Conditions
No purchase necessary to enter or claim a prize. A purchase will not increase your chance of winning a prize. Chances of claiming a prize depend on the total number of eligible entries received.
Eligibility
The Finder.com x Enjin NFT Sweepstakes (“Sweepstakes”) is open to entrants who are at least 18 years old and legal residents of, physically located in and with a primary residence in the United States or District of Columbia at the time of entry (“Entrant”). Void where prohibited by law. All federal, state and local laws and regulations apply.
These Terms and Conditions are to be read in conjunction with the Finder.com (“Finder”) Terms and Conditions and Privacy Policy. Participation constitutes Entrant’s full and unconditional agreement to and acceptance of these Terms and Conditions, and the decisions of Finder, which are final and binding in all matters relating to the Sweepstakes and shall not be subject to appeal.
Employees, representatives, and agents of the Finder and its respective parent, affiliates and subsidiaries and the immediate family members — herein defined as spouse, siblings, children and each of their respective spouses, regardless of residence, and any person living in such a person’s household, whether related or not (“Representatives”) — as well as the Representatives of Enjin Pte. Ltd (“Enjin”) or any other company affiliated with the Sweepstakes (collectively “Sweepstakes Entities”) are not eligible to participate.
How to Enter
No purchase required. An Entrant can claim and collect only one NFT (“Prize”) from each category. The four (4) NFT categories will be released weekly at 9 a.m. ET on February 18, February 25, March 4 and March 11, 2022 (“Competition Dates”). The NFTs will be available starting on their released Competition Dates, until supplies run out (collectively “Competition Period”) or until June 1, 2022 (whichever comes first). The Sweepstakes Entities reserve the right to close the Competition Period earlier, without warning. Each NFT is valued 0.0001 ENJ — Enjin’s native utility token. The NFTs feature four animated characters inspired by Finder’s values:
- Friday, February 18. 20,000 “Compare” class NFTs, celebrating Finder’s mission to compare financial products with an unbiased eye.
- Friday, February 25. 10,000 “Save” class NFTs, because Finder believes that money saved is money earned.
- Friday, March 4. 5,000 “Control” class NFTs, since controlling your finances means taking charge of your life.
- Friday, March 11. Only 5 “Empower” class NFTs, because ultimate power comes from comparing, saving and controlling your money like a pro.
To enter the Competition and claim your NFT, the Entrant must find the Enjin QR Code in Finder.com, download the Enjin mobile application (“Enjin App”) and create a digital Enjin Wallet, if they do not already have one, and scan the QR code using the Enjin App. Establishing an Enjin account is free. Each NFT is infused with 0.0001 ENJ, which is Enjin’s native cryptocurrency. The NFT is a digital asset that may gain or lose value over time, depending on the market. Entering the Sweepstakes more than once during the Competition Period, including by registering for additional user accounts in the Enjin App, does not result in additional entries. By entering the Sweepstakes and using the Enjin App, you agree to abide by Finder and Enjin’s Terms of Use and Privacy Policy.

Prizes and Approximate Retail Values (“ARV”): Each NFT is valued in cryptocurrency 0.0001 ENJ — Enjin’s native utility token. Total ARV awarded is approximately $0.02 USD as of February 17, 2022. Cryptocurrency prices are highly volatile and sensitive to secondary activity. Prizes must be accepted as awarded. If the actual value of a Prize is less than the stated ARV, the difference will not be awarded. All Prizes are nontransferable and nonassignable and cannot be redeemed or substituted for cash or credit. Prizes pictured in advertising, marketing or promotional materials are for illustrative purposes only. Prizes are awarded “as is” with no warranty, representation or guarantee, express or implied, in fact or in law, made by Sweepstakes Entities.
In the event of a discrepancy or inconsistency between statements contained in any such materials and the Terms and Conditions, these Terms and Conditions shall prevail, govern and control.
Sweepstakes Entities are not responsible for any cancellations, delays, diversions or substitutions, or any act or omission whatsoever with respect to any Prize. Sweepstakes Entities reserve the right (but have no obligation) to substitute an alternative Prize, in whole or in part, of equal or greater monetary value if a Prize cannot be awarded, in whole or in part, as described, for any reason. The approximate retail value of the Prizes is based on available information provided to Finder and the value of any Prize awarded may be reported for tax purposes as required by law. The winner may be required to provide Finder with a valid Social Security number or tax identification number before the Prizes will be awarded.
By accepting the Prize, Entrant agrees to, except where prohibited by law, Finder and its designees’ use of winner’s name, biography, likeness, voice, photographs, video, opinions, statements, hometown or city, state and country, including for publicity, advertising and promotional purposes in any manner or media — including, without limitation, online, on websites and in social media — worldwide, in perpetuity, now or hereafter, without further notice, permission, payment, consideration or compensation and, upon request, will provide consent to such use in writing.
Privacy Policy
Entrant’s information collected in connection with this Competition may be shared with Enjin to execute the Sweepstakes and/or deliver the NFT. Enjin will use such information in accordance with this Privacy Policy. Except as otherwise contemplated in these Terms and Conditions, personal information provided by Entrants is subject to Finder’s and Enjin’s Privacy Policies at https://www.finder.com/privacy-policy and Enjin Privacy Policy at https://www.enjin.com/privacy.
General Information
By entering this Sweepstakes, Entrants accept and agree to be bound by these Terms and Conditions and the decisions of Finder on all matters relating to the Sweepstakes, which are final and binding.
The winner is solely responsible for all local, state, federal and provincial taxes on the prizes including sales or use taxes, as well as any cost associated with accessing the Competition website dependent on the Internet service provider used, expenses related to participation in the Sweepstakes or acceptance of an NFT. By participating, Entrant agrees to release and hold harmless Sweepstakes Entities, and their respective divisions, affiliates, subsidiaries, parent companies and each such entities’ officers, directors, employees, agents and representatives from any injury, loss or damage to person, including death, personal injury or loss or damage to property due in whole or in part, directly or indirectly, to the acceptance or use/misuse of a prize, participation in any promotion-related activity or participation in the Competition.
Sweepstakes Entities are not responsible for any typographical or other error in the printing of this offer, administration of this Sweepstakes or in the announcement of NFT claimant. In the event that Sweepstakes Entities are prevented from continuing with this Competition, or the integrity and/or feasibility of the Competition as planned is undermined by any event including but not limited to fire, flood, pandemic, earthquake, labor dispute or strike, act of God or public enemy, any federal, state or local government law, order or regulation, order of any court or jurisdiction or undermined by extraordinary and unavoidable circumstances under the given conditions (each a “Force Majeure” event or occurrence), Sweepstakes Entities shall have the right, in their sole discretion, to abbreviate, modify, suspend, cancel or terminate the Sweepstakes and honor the NFts from among all eligible Entrants up to that date.
Sweepstakes Entities reserve the right, at any time, to verify the validity of entries and Entrants — including an Entrant’s identity, age and place of residence — and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at Finder’s discretion. Failure by the Sweepstakes Entities to enforce any of their rights at any stage does not constitute a waiver of those rights. Sweepstakes Entities are not responsible for and may disqualify entries that are misdirected, undelivered, incomplete, illegible, inaccurate, damaged, stolen, late, or lost; or for interrupted or unavailable network, server, Internet Service Provider, website or other connections; or for computer hardware or software malfunctions, failures or difficulties. No automatic, robotic, or mechanical entries, accepted. Finder reserves the right to void all Entries made through any robotic, automatic, mechanical, programmed, or similar entry duplication method, and to disqualify any individual using such an entry method. Proof of submission of an entry does not constitute proof of receipt of entry by Finder. If there is a dispute as to the identity of Entrant or a dispute, or potential dispute regarding the entry or any third-party rights, or if Finder has reasonable grounds for suspecting any breach or abuse of these Terms and Conditions by any person involved in an entry, the affected entry will be deemed ineligible in Finder’s sole discretion.
Except for any liability that cannot be excluded by law, Finder — including its officers, employees and agents — excludes all liability, including negligence, for any personal injury; or any loss or damage, including loss of opportunity; whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under Finder’s control); (b) any theft, unauthorized access or third-party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Finder) due to any reason beyond the reasonable control of Finder; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of the Prize.
By entering this Competition, Entrants acknowledge that: cryptocurrencies are speculative, complex and involve significant risks; cryptocurrencies are highly volatile and sensitive to secondary activity; performance is unpredictable; and past performance is no guarantee of future performance. They will consider their own circumstances, and obtain their own advice, before participating in this Competition or purchasing or selling cryptocurrencies. They will also verify the nature of any product or service — including its legal status and relevant regulatory requirements — and consult the relevant Regulators’ websites before making any decision, and this Competition should not be interpreted as an endorsement of cryptocurrency or any specific provider, service or offering. It is not a recommendation to trade.
Governing Law: All disputes will be resolved solely by binding arbitration and Entrants waive the ability to bring claims in a class action. Disputes concerning the construction, validity, interpretation and enforceability of these Terms and Conditions or the rights and obligations of Entrants or Sweepstakes Entities in connection with the Sweepstakes shall be governed by and interpreted in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. The parties hereby consent to exclusive jurisdiction and venue of the state and federal courts located in the State of Delaware.
BY ENTERING THE COMPETITION, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED FIFTY DOLLARS ($50.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (2) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES NOT TO EXCEED FIFTY DOLLARS ($50.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (3) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO BRING OR JOIN IN ANY CLASS ACTION REGARDING THE COMPETITION.
